1 PRIVACY AND YOUR PERSONAL DATA

1.1 The Babbacombe Theatre (“Theatre”, “us”, “we” or “our” for short) is committed to protecting the privacy of our users. This Privacy Policy (“Policy”) is intended to inform you how we gather, define, and utilise your Information (as defined below). This Policy is intended to assist you in making informed decisions when using the website, http://www.babbacombe-theatre.com (the “Website”). Please take a minute to read and understand the Policy.

1.2 This Policy, and our separate “Cookies Policy” are incorporated into and form part of our Website Terms of Use.

1.3 All your Information (as defined below) shall be held and used in accordance with the General Date Protection Regulation (GDPR), from 25 May 2018. 1.4 The Theatre is the data controller of your Information for the purposes of the Act and is a company registered under the name, Matpro Limited, registered in England, business number 2547301 whose registered office is at Cary Point, Babbacombe Downs Road, Torquay, Devon TQ1 3LU. The Theatre shall ensure that your Information is processed and held in accordance with the regulations specifies by GDPR act.

2 WHAT INFORMATION DO WE COLLECT AND WHY?

2.1 When you visit the Website you may provide us with your name; email address and telephone number on the “Contact us” page. This information will be retained whilst we process your enquiry. Once you are satisfied and your enquiry has been resolved, the details you supplied will be deleted from our system.

(a) If you choose to correspond with us by email, we may retain the content of your email messages together with your email address and our responses for purposes of reference. Albeit, this information will stay on our system for no longer than 3 months.

2.2 We may also collect information about your computer, including where available your IP address, operating system and browser type and the geographical location of your computer, for system administration. This is statistical data about browsing actions and patterns and does not identify you as an individual.

2.3 You may provide us with more Information, most specifically when booking for show tickets and/or subscribing to register for the e-newsletter. The additional information will include your postal address and your preference of shows you wish to be advised of, if signing up for the e-newsletter. PLEASE NOTE: if booking direct at the box office you will also be asked to give us these details.

2.4 When booking your tickets, the information you submit will be received via the venues ticketing provider TICKETSOLVE and the payment portal, GLOBAL PAYMENTS. Details on the cookies used are covered in in section 4 of this document.

2.4(a) When you purchase tickets for a show, legally in order to contact you about the event you are attending, we can retain those details, which are stored securely via Ticketsolve. If the event is postponed or cancelled, we will need to be able to notify you either by phone or email. Whilst not our current practise you, the patron, may also be contacted to collect feedback following the event/show you attended. All this is covered under the ‘Performance of Contract’. Once the show date has passed unless you have signed up to a member to the website or requested to take receipt of our monthly E-Newsletter your details will be removed automatically from the system.

2.4(b) By supplying us with the Information listed above, through subscribing to receive news, promotions, information or updates from our online services Google Analytics will gather this information

2.5 If you have advised us either by post/telephone or email of your address for the purpose of purchasing a show DVD, your address will be stored by the data control officer, Mrs Katie Sorto for the period of 21 days. In the event your DVD does not arrive we can check to establish the postal date and details of the address submitted.

3 HOW DO WE USE THE INFORMATION THAT YOU PROVIDE TO US?

3.1 We use your Information in the following ways:

(a) to ensure that content from the Website is presented in the most effective manner for you and your computer;

(b) to notify you about our services and any changes that may occur;

(c) in accordance with your authorisation as expressed when you subscribe to any online service provided by us or when you correspond with us.

4 UNDERSTANDING HOW AND WHY WE USE COOKIES

4.1: We use cookies on our website (www.babbacombe-theatre.com) to create the most accessible and effective website possible for our customers. Cookies allow you choose preferences and access products and services online.

4.1(a): Do cookies mean I could get cold calls or junk mail?

The cookies we use do not contain any information which would allow us to identify you. We may use cookies to show you subtly tailored content on our site of things we think you might be interested in.

4.1(b) Do cookies compromise my security when using your website?

The cookies we use are completely safe and secure. In fact, they are used purely to provide essential functionality which allow you to browse the website. 5 WHAT ARE COOKIES

Cookies are small text files that are sent to and stored on your computer, smartphone or other device for accessing the Internet, whenever you visit a website. Cookies are useful because they allow a website to recognise a user's device. At the Babbacombe Theatre, we use cookies to let users navigate between pages efficiently and enable other essential functionality.

For example, instead of displaying promotional messages about products you already have, they let us show you other services you may be interested in. When we include links to other websites, including Ticketsolve, the provider of the service to our box office system where you can purchase your tickets online, Global Payments our payment service provider and Mailchimp for customers enrolling to take receipt of our E-newsletter please bear in mind they will have their own privacy and cookie policies that will govern the use of any information you submit. We recommend you read their policies as we are not responsible or liable for their privacy practises, albeit we have 100% confidence of their GDPR policy and application.

Functionality and performance cookies

These cookies give you extra functionality, such as being able to ask us to remember your preferences. They also let us monitor how our website is performing so we can make regular improvements.

Ticketing Data

When you purchase tickets, gift vouchers, merchandise or membership through our Box Office at the Babbacombe Theatre, Babbacombe Downs Road Torquay, your name, email, phone number, and address data number will be stored by our ticketing partner, TicketSolve.

 Online Data

When you book tickets online, data is shared between Sample Organisation Global Payments (payment gateway), and Ticketsolve (ticketing platform) in order to process the transaction. Where patrons have opted to provide their details for mailings, data will be shared with MailChimp (Ticketsolve’s email partner).

Ticketsolve acts as a data processor on behalf of the Babbacombe Theatre. Ticketsolve, Global Payments & MailChimp have implemented appropriate technological measures to protect against accidental loss, destruction, damage, alteration, or disclosure. Website Cookies

When someone visits our website and books tickets (https://babbacombe-theatre.ticketsolve.com) we use a number of third party services to collect standard internet log information and details of visitor behaviour patterns. We do this to find out things such as the number of visitors to the various parts of the site, types of devices used, and length of time on pages.

Disabling cookies

You can prevent the setting of cookies by adjusting the settings on your browser. Please note however that disabling cookies may result in the disabling of certain functionality and features of our website.

 6 HOW CAN YOU ACCESS AND CORRECT YOUR INFORMATION?

You may request access to all your Information that we collect online and maintain in our database by emailing [email protected], note please add in the subject bar ACCESS DATA. A Subject Access Request will be free and will conform to the GDPR.  A Data Subject Access Form will be sent to you for completion and we will process your request within 30 days.

7 YOUR CONSENT

By using the Website, you consent to our collection and use of your Information as described in this Policy. If we change our Policy and/or procedures, we will post those changes on the Website to keep you aware of what Information we collect, how we use it and under what circumstances we may disclose it.

7.1: You have the right to ask us not to process for marketing purposes Information we collect from you. You can exercise your right to prevent such processing of your Information by not ticking the relevant box(es) on the form(s) we use to collect your Information. You can also exercise the right at any time by contacting us at [email protected] to have your data deleted.

8 WHERE WE STORE YOUR INFORMATION

8.1 The Information that we collect from you will be stored at a destination inside the European Economic Area. Ticketsolve servers Dublin, Ireland/Global payments servers EEA/Mailchimp servers Switzerland. The Information may also be processed by staff operating outside the EEA who work for us or for one of our suppliers; such parties are certified under the Privacy Shield arrangements. By submitting Information to us, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your Information is treated securely and in accordance with this Policy.

9 SECURITY & PAYMENT PROCESSING

9.1 We maintain the highest standards of security; however, the transmission of information via the internet is not completely secure, albeit our website is PCI compliant. Any transmission of Information from you to us is at your own risk. Once we have received your Information, we will use strict procedures and security features to prevent unauthorised access.

9.2 Pay and Shop Limited, trading as Global Payments has its registered office at The Observatory, 7-11 Sir John Rogerson's Quay, Dublin 2 and is registered in Ireland. Global Payments is a trading name of GPUK LLP. GPUK LLP is authorised by the Financial Conduct Authority under the Payment Service Regulations 2009 (504290) for the provision of payment services and under the Consumer Credit Licence (714439) for the undertaking of terminal rental.

Global Payments is certified as a Level 1 PCI Compliant payment services provider, a certification provided by an accredited third party. In order to maintain this status, Global Payments submits to an annual security audit and employs an in-house security team who monitor Global Payments' systems on an ongoing basis. As a condition of achieving and maintaining that level of compliance, Global Payments is responsible for the security (but not the accuracy or legality) of any data submitted by the Client to Global Payments as card data for processing, transmission, or storage, but only for so long as such data remains within Global Payments' systems.
